Hell is empty, all devils are he

I don’t understand why a person who killed another so cruelly may not face the death penalty. What is really matters?  Long time ago, I have read a passage about why there would be attorneys for the obvious criminal. The law is so complicated. It reminds me that “Hell is empty, all devils are here.”, which is from the Tempest written by Shakespeare.
